The silent battle over your family’s private data is intensifying. Most remain oblivious to this clash as it unfolds in the hushed corridors of state legislatures. As a Vermont state representative and champion of one of the nation’s most potent data privacy bills, I’ve been on the frontlines of this struggle. Meta, Google, Amazon, and other tech behemoths have much at stake as Vermont and other states strive to fortify consumer data protections. Every social media update, search inquiry, and digital trace – even those left by children and teenagers – are valuable commodities to these companies, fueling their colossal profits. To keep this data deluge flowing, Big Tech has launched an unyielding campaign to mislead and befuddle lawmakers.
These corporations are crafty players. As trillion-dollar entities facing mounting criticism for their business models, they wisely choose not to be the public face of their influence peddling. Instead, they inundate legislatures with industry trade associations that parrot their narratives and forge alliances with other influential companies and organizations.
Their strategy is ruthless. Initially, they aim to strangle a robust privacy bill by stalling its progress. If that fails, Plan B involves diluting the bill by persuading lawmakers to strip or weaken its key provisions. The endgame? A gutted “privacy” bill that makes for good press but offers scant real data protection.
In Vermont, the Connected Commerce Council (C3), a group claiming to “empower small businesses,” had much to say about our privacy bill. This caught lawmakers’ attention, who view small business owners as the state’s economic backbone and a crucial voting bloc. But I later discovered that C3 is funded by Big Tech and had falsely inflated its membership with small businesses unaware of the group’s existence.
Amidst this onslaught, my Vermont colleagues and I convened a public hearing to share experiences with other lawmakers nationwide who’ve attempted to pass privacy legislation. This hearing underscored that we weren’t the first legislators to confront Big Tech’s formidable lobbying machine.
Learning from other states’ experiences, we refined our privacy bill’s language and chose to retain a crucial provision called a “private right of action.” This allows Vermont residents to sue tech companies over privacy breaches.
